By accessing or using PatchWatch ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our Service.
PatchWatch is a security patch monitoring and vulnerability tracking platform that provides automated alerts for software updates, CVEs, and security patches across multiple data sources including MSRC, NVD, and OSV databases.
Free plan users may monitor up to 5 products with limited features. Free plan limits may change with notice.
Pro plan subscribers receive unlimited product monitoring, priority support, and advanced features as described on our pricing page. Subscription fees are billed monthly or annually.
You agree NOT to:
PatchWatch aggregates security information from third-party sources (MSRC, NVD, OSV, CISA). While we strive for accuracy, we do not guarantee the completeness, timeliness, or accuracy of this data. PatchWatch is an informational tool and is NOT a replacement for comprehensive security audits or dedicated vulnerability scanning. You assume full responsibility for verifying critical security information and executing patch deployments safely within your infrastructure.
We aim for high availability but do not guarantee uninterrupted service. We are not liable for any failure or delay in performance resulting from circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, acts of government, power failures, or outages caused by upstream data providers (e.g., MSRC API downtime). We will provide reasonable notice for planned maintenance via email or in-app notifications.
The Service, including its design, features, and content, is owned by PatchWatch and protected by intellectual property laws. You may not copy, modify, or distribute any part of the Service without permission.
You agree to defend, indemnify, and hold harmless PatchWatch, its affiliates, and its employees from any claims, damages, liabilities, costs, or expenses (including reasonable attorneys' fees) arising out of or related to your use of the Service, your violation of these Terms, or any data breaches or security incidents within your organization, regardless of whether PatchWatch alerted you to the underlying vulnerability.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, PATCHWATCH SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUGS, EXPLOITS, RANSOMWARE, LOSS OF DATA, PROFITS, OR BUSINESS OPPORTUNITIES, ARISING FROM YOUR USE OR INABILITY TO USE THE SERVICE. IN NO EVENT SHALL PATCHWATCH'S TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE EXPLICITLY DISCLAIM ALL WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE ERROR-FREE, SECURE, OR UNINTERRUPTED.
We may suspend or terminate your account for violations of these Terms. You may cancel your account at any time. Upon termination, your right to use the Service ceases immediately.
We may modify these Terms at any time. We will notify you of material changes via email or through the Service. Continued use after changes constitutes acceptance of the new Terms.
These Terms are governed by the laws of the jurisdiction in which PatchWatch operates. Any disputes shall be resolved through binding arbitration or in the courts of competent jurisdiction.
